Terms and Conditions of Use

1. USE AND RESTRICTIONS.

The use of the Web Page is subject to full compliance without reserve by the user according to these Terms and Conditions of Use and Privacy. Through the Web Page, the user will access and/or use various services and content (henceforth called “Services and Content”), made available to the user by members of Caladero, and/or by third-party providers of Services and Content. At its entire discretion Caladero retains the right to totally or partially refuse, restrict, or adapt user’s access to the Web Page, as well as to modify the Service and Content of the Web Page at any time without prior notice.

Caladero will not be held responsible for any damage or loss of any nature which might be caused by the lack of availability or continuity of operation of the Web Page and/or the Services and Content. .

2. INTELLECTUAL PROPERTY.

The intellectual property rights pertaining to the Services and Content and the distinctive symbols and Web Page domains, as well as the right to their use and development, including its disclosure, publication, reproduction, distribution, and transformation, are the exclusive property of Caladero. The user does not acquire any right to intellectual property by the mere use of the Services and Content of the Web Page and at no time will said use be considered as authorization or permission to use the Services and Content with any other purpose than those expressed in these Terms and Conditions of Use.

3.THIRD-PARTY INTELLECTUAL PROPERTY.

The user agrees that the provisions established in sub-paragraph 2 above regarding entitlement to the Caladero rights are also applicable to third-party rights with regards to Service and Content of pages linked to the Web Page.

4. USES PERMITTED.

The use of the Services and Content of the Web Page is the exclusive responsibility of the user, who should make use of them, in any case, according to the applications allowed on the Web Page itself and by the authorized uses in these Terms and Conditions of Use, by which the user is obligated to use them in such a way that does not infringe the rules of use and coexistence on the Internet, Spanish laws, the legislation in force in the country in which the user is located while using them, good manners, personal dignity, and third-party rights. The Web Page is for the personal use of the user, and for this reason the user may not use the Service and Content for any business purpose.

5. RESTRICTIONS.

The user does not have the right to place links from or to the Web Page on their own sites or pages or those of third parties without previous authorization in writing from Caladero. In addition, the user will not have the right to limit or obstruct the use of the Web Page to any other user.

6. QUALITY OF SERVICES AND CONTENT.

Caladero will not be held responsible for any damage or harm suffered by the user due to inaccuracies, typographical errors, or changes or improvements made periodically to the Services and Content.

7. COOKIES.

The user, who has access to the Web Page, agrees to receive the cookies which are transmitted by the Caladero servers. "Cookie" means a data file that is stored on the hard disk of the user’s computer when he/she accesses the Web Page. Cookies may contain information such as the identification provided by the user or information to track the pages the user has visited. A Cookie cannot read the data or information on the user’s hard disk nor read Cookies created by other sites or pages.

8. ACCESS CODES AND CONFIDENTIAL NUMBERS.

It is at all times the user’s sole responsibility to maintain the secrecy of his/her account numbers, personal passwords, access codes, and confidential numbers with which he/she gains access to the Services and Content of the Web Page, as well as those of third parties.

9. MODIFICATIONS.

Caladero retains the right to modify the Terms and Conditions of Use and Privacy at any time. Therefore the user should carefully read the Terms and Conditions of Use and Privacy each time he/she intends to use the Web Page. Certain Services and Content offered to the users on and/or through the Web Page are subject to their own particular conditions, which replace, complete, and/or modify the Terms and Conditions of Use and Privacy.

10. APPLICABLE LAWS AND JURISDICTION.

For the purpose of interpretation, compliance, and execution of this Contract, the parties agree that the Spanish laws and the competent courts of Zaragoza will apply, expressly waiving any other law or jurisdiction which could correspond based on present or future residences.
